Terms
Last updated 9 October 2026. These terms govern the use of the website cloudq.io and the CloudQ Growth service. By creating an account or using the service you accept these terms.
The agreement is entered into between CloudQ AS, org. no. 924 352 922, Øvre Bogenvei 1A, 3152 Tolvsrød, Norway ("CloudQ") and the business ordering the service (the "Customer"). These terms apply together with the order confirmation or quote and the data processing agreement. In case of conflict, the order confirmation prevails over these terms.
CloudQ Growth is a cloud-based service for marketing operations. The service connects to the Customer's ad accounts, tracking, website and analytics tools, monitors them with automated agents, and proposes actions that the Customer can approve. CloudQ may change and develop the service continuously, but will not remove material functionality without reasonable notice.
The Customer is responsible for the users it grants access, for keeping login credentials confidential, and for all activity through the Customer's accounts. The Customer shall notify CloudQ immediately if unauthorised access is suspected. Access to third-party platforms is granted by the Customer and can be revoked at any time.
The Customer must have the right to give CloudQ access to the accounts and data it connects, and is responsible for ensuring that content, ads and claims it publishes are lawful and comply with platform policies. CloudQ's compliance features are an aid and do not replace the Customer's own assessment or legal advice.
The agents in the service do not make changes to the Customer's accounts without the Customer's approval, except for actions the Customer has explicitly set to run automatically. Changes to budgets and bids always require manual approval. Executed actions are logged and can as a rule be undone within 14 days. CloudQ does not guarantee specific results, return or effect of recommendations. The decision to approve an action is the Customer's own.
Prices follow from the quote or order confirmation and are invoiced in advance per month or year, with 14 days payment terms. All prices exclude VAT. On late payment, statutory interest applies and CloudQ may suspend access after written notice. Price changes are announced with at least 30 days notice and apply from the next invoicing period.
CloudQ retains all rights to the service, the software, the agents, the documentation and aggregated, anonymised usage data. The Customer retains all rights to its own data, content and ad accounts. The Customer grants CloudQ a limited right to process Customer data to the extent necessary to deliver the service.
Processing of personal data is governed by the data processing agreement and the privacy policy. Customer data is stored in the EU/EEA and is not disclosed to third parties for their own purposes. On termination the Customer may request an export of its data within 30 days, after which the data is deleted in line with the privacy policy.
CloudQ aims for 99.5% monthly availability, measured excluding planned maintenance announced in advance. The service depends on third-party platforms and APIs, and CloudQ is not liable for downtime, changes or limitations on their side. Support is provided by email on weekdays between 09:00 and 16:00 CET.
CloudQ is not liable for indirect loss, including lost profit, lost ad revenue, loss of data or loss resulting from actions the Customer has approved. CloudQ's total liability is limited to the amount the Customer has paid for the service in the twelve months preceding the claim. These limitations do not apply in case of gross negligence or wilful misconduct.
The agreement runs from the agreed start date and renews automatically for the same period unless terminated in writing no later than 30 days before expiry. Either party may terminate the agreement for material breach that is not remedied within 14 days of written notice. On termination access is closed, and the provisions on rights, liability and data continue to apply.
CloudQ may change these terms with 30 days written notice. If a change is materially detrimental to the Customer, the Customer may terminate the agreement with effect from the date the change takes effect. Continued use after that date constitutes acceptance.
The agreement is governed by Norwegian law. Disputes shall first be sought resolved amicably. Failing that, Oslo District Court is the agreed venue. Questions about these terms can be sent to hello@cloudq.io.
